Terms of Service

1. Acceptance of Terms

By accessing or using ScamShield AI at scamshieldai.com.au, our Telegram bots (@TheScamShieldAIBot and @ScamShieldProBot), or any related products and services (collectively, the "Service"), you agree to be bound by these Terms of Service and our Privacy Policy.

If you do not agree to these terms, do not use our Service. These terms constitute a legally binding agreement between you and Agronos Pty Ltd (ABN/ACN to be inserted), incorporated in Australia.

2. Description of Service

ScamShield AI provides AI-powered scam detection and analysis tools. Our services include:

• Web-based scanner for text messages, emails, URLs, phone numbers and crypto addresses
• Screenshot and image analysis using Vision AI
• Telegram bots for scam scanning and community reporting
• Phone number intelligence and lookup tools
• Cryptocurrency wallet and token risk analysis
• ICO and presale audit tools (premium)
• Weekly scam intelligence reports and alerts

The free tier provides 10 lifetime scans. Premium subscriptions offer unlimited scanning and additional features as described on our pricing page. Features are subject to change with reasonable notice.

3. Accounts & Subscriptions

Account registration

Some features require you to create an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at support@scamshieldai.com.au if you suspect unauthorised access.

Subscriptions

Premium subscriptions are billed monthly or annually as selected at checkout. All prices are in Australian Dollars (AUD) and include GST where applicable. Subscriptions renew automatically unless cancelled before the renewal date.

Free trial

Where offered, a 7-day free trial provides full access to the selected subscription tier. You will not be charged during the trial period. Cancellation before the trial ends incurs no charge.

4. Acceptable Use

You may use ScamShield AI only for lawful purposes and in accordance with these Terms. Permitted uses include:

• Checking suspicious messages, links, emails and content for personal or professional safety
• Verifying crypto tokens, wallets and websites before engaging with them
• Reporting scam activity to assist our community reporting program
• Accessing scam intelligence reports and alerts for awareness purposes

5. Prohibited Uses

You must not use ScamShield AI to:

• Test, probe or reverse-engineer scam detection systems to evade detection
• Submit content that violates the privacy of third parties without their consent
• Attempt to circumvent usage limits, rate limits or access controls
• Share account credentials or permit unauthorised access to paid features
• Automate requests to our APIs without prior written permission
• Use the Service to harass, threaten or harm any individual
• Submit content that is illegal, defamatory or infringes the rights of others
• Introduce malware, bots or other harmful code to our systems

6. Accuracy of Results

ScamShield AI provides automated, AI-generated risk assessments based on data from third-party sources. Our results are indicators only and are not guaranteed to be accurate, complete or up to date.

• A "Legit" verdict does not confirm that something is safe — always verify independently
• A "Scam" verdict does not constitute legal proof of fraud or wrongdoing
• Automated tools can miss new or novel scam techniques not yet in our database
• Nothing on ScamShield AI constitutes financial, legal or investment advice

You remain solely responsible for any decisions you make based on scan results. If you have lost money to a scam, contact your bank and the relevant authorities listed on our site.

7. Intellectual Property

All content, code, design, trademarks and materials on ScamShield AI are the property of Agronos Pty Ltd or our licensors and are protected by Australian and international intellectual property laws.

You may not copy, reproduce, distribute or create derivative works from any part of our Service without our prior written consent. The ScamShield AI name, shield logo and related marks are trademarks of Agronos Pty Ltd.

Content you submit for scanning remains your property. By submitting content, you grant us a limited licence to process it for the purpose of delivering scan results and, in anonymised aggregate form, for improving our detection models.

8. Payments & Refunds

Payments

All payments are processed securely by Stripe, Inc. We do not store your payment card details. By subscribing, you authorise Stripe to charge your payment method on a recurring basis until you cancel.

Cancellation

You may cancel your subscription at any time through your account settings or by contacting support@scamshieldai.com.au. Cancellation takes effect at the end of your current billing period. You retain access to premium features until that date.

Refunds

We offer a full refund within 7 days of your first subscription payment if you are not satisfied. After 7 days, refunds are assessed on a case-by-case basis. Contact support@scamshieldai.com.au to request a refund. Refunds are not available for one-time purchases such as the Evidence Pack once it has been downloaded.

Price changes

We may change subscription prices at any time. We will provide at least 30 days' notice of any price increase. Continued use after the notice period constitutes acceptance of the new pricing.

9. Limitation of Liability

To the maximum extent permitted by Australian law, Agronos Pty Ltd and its directors, employees and agents are not liable for:

• Any indirect, incidental, special or consequential loss arising from your use of the Service
• Financial losses resulting from decisions made based on scan results
• Loss of data, profits, revenue or business opportunities
• Interruption or unavailability of the Service
• Accuracy or completeness of third-party data used in scan results

Where liability cannot be excluded under the Australian Consumer Law (Competition and Consumer Act 2010 (Cth)), our liability is limited to re-supplying the relevant service or the cost of having the service supplied again.

Nothing in these Terms excludes your rights as a consumer under the Australian Consumer Law.

10. Termination

We may suspend or terminate your access to ScamShield AI at any time, with or without notice, if we believe you have violated these Terms. Upon termination:

• Your right to use the Service ceases immediately
• Any outstanding subscription fees remain payable
• Provisions that by their nature should survive termination (including limitations of liability, intellectual property and governing law) will continue to apply

11. Governing Law

These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales for any disputes arising from these Terms or your use of the Service.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

12. International Users

ScamShield AI welcomes users from Australia, the United Kingdom, the United States, Canada and New Zealand. While these Terms are governed by the laws of New South Wales, Australia, users in other countries have additional rights under their local consumer protection and data laws which these Terms do not override.

🇬🇧 United Kingdom Users

If you are in the United Kingdom, your rights as a consumer are protected by the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and related legislation. Nothing in these Terms removes or limits your statutory rights under UK law. In particular:

• You have the right to cancel a digital subscription within 14 days of purchase (cooling-off period), unless you have expressly requested the service begin within that period
• Our services must be provided with reasonable care and skill under the Consumer Rights Act 2015
• You may refer unresolved disputes to the UK's Citizens Advice consumer service at citizensadvice.org.uk or to Alternative Dispute Resolution (ADR) schemes
• Disputes may also be referred to the Financial Ombudsman Service if they relate to financial services

For UK users, references to "Australian Consumer Law" in Section 9 should be read to include the Consumer Rights Act 2015 and related UK consumer legislation.

🇺🇸 United States Users

If you are located in the United States, the following additional terms apply:

• ScamShield AI is provided "as is" to the fullest extent permitted under applicable state law. Some states do not allow exclusion of implied warranties, so this exclusion may not apply to you.
• Some states limit the exclusion of consequential or incidental damages. In those states, our liability is limited to the fullest extent permitted by law.
• If you are a California resident, you may have additional consumer rights. Contact the California Department of Consumer Affairs at dca.ca.gov for more information.
• Disputes between US users and Agronos Pty Ltd will be resolved by binding arbitration under the rules of the American Arbitration Association (AAA), unless you opt out within 30 days of first use by emailing support@scamshieldai.com.au with subject "Arbitration Opt-Out". Class action waivers apply where permitted by law.
• ScamShield AI scan results do not constitute legal advice and are not admissible as evidence of fraud in US legal proceedings without independent verification.

🇨🇦 Canada Users

If you are located in Canada, the following additional terms apply:

• Your consumer rights are protected under applicable federal and provincial consumer protection legislation, including the Competition Act, provincial consumer protection acts, and Quebec's Consumer Protection Act
• Quebec residents have additional rights including a minimum 10-day cooling-off period for certain distance contracts
• Subscription auto-renewal disclosures: your subscription will automatically renew unless cancelled before the renewal date. You will receive a renewal reminder by email where required by provincial law.
• Prices displayed include applicable Canadian taxes where required. GST/HST/QST will be applied where applicable based on your province of residence.
• Disputes may be referred to your provincial consumer protection office. In Quebec, disputes may be referred to the Office de la protection du consommateur at opc.gouv.qc.ca.

🇳🇿 New Zealand Users

If you are located in New Zealand, the following additional terms apply:

• Your consumer rights are protected by the Consumer Guarantees Act 1993 (NZ) and the Fair Trading Act 1986 (NZ). Nothing in these Terms limits your rights under these Acts.
• Under the Consumer Guarantees Act 1993, our services come with guarantees that cannot be excluded, including that services will be carried out with reasonable care and skill and be fit for purpose.
• You have a right to a remedy (repair, replacement or refund) if a service fails to meet a consumer guarantee.
• Prices are displayed in AUD. GST under New Zealand law may apply to purchases made by New Zealand-based consumers. We will apply NZ GST where required.
• Disputes may be referred to the Disputes Tribunal at disputestribunal.govt.nz for claims up to NZD $30,000, or to the Commerce Commission at comcom.govt.nz for Fair Trading Act concerns.

13. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and notify registered users by email where appropriate.

Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
